DECREE OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE
NUMBER KEP-25/BC/2010

CONCERNING
FULLY IMPLEMENTATION (MANDATORY) OF ELECTRONIC DATA EXCHANGE FOR NOTIFICATION OF IMPORTED GOODS TO BE PILED IN BONDED STORAGE

DIRECTOR GENERAL OF CUSTOMS AND EXCISE,

Considering:

a. that the try out implementation of Electronic Data Exchange (PDE) application program for the submission of Notification of Imported Goods documents in Bonded Storage (BC 2.3) has been implemented and running smoothly so it is necessary to be applied in fully;

b. that based on the considerations as intended in paragraph a, it is necessary to issue the Decree of the Director General of Customs and Excise concerning Fully Application (Mandatory) of Electronic Data Exchange for Notification of Imported Goods to be piled on Bonded Storage;

In view of:

1. Law Number 10 of 1995 concerning Customs (Statute Book of the Republic of Indonesia Number 75 of 1995, Supplement to Statute Book of the Republic of Indonesia Number 3612); as amended by Law Number 17 of 2006 (Statute Book of the Republic of Indonesia Number 93 of 2006, Supplement to Statute Book of the Republic of Indonesia Number 4661);

2. Law Number 11 of 1995 concerning Excise (Statute Book of the Republic of Indonesia Number 76 of 1995, Supplement to Statute Book of the Republic of Indonesia Number 3613); as amended by Law Number 39 of 2007 (Statute Book of the Republic of Indonesia Number 105 of 2007, Supplement to Statute Book of the Republic of Indonesia Number 4755);

3. Government Regulation Number 32 of 2009 concerning Bonded Storage (Statute Book of the Republic of Indonesia Number 61 of 2009, Supplement to Statute Book of the Republic of Indonesia Number 4998);

4. Regulation of the Minister of Finance Number 155/PMK.04/2008 concerning Customs Notification;

5. Regulation of the Director General of Customs and Excise Number P-20/BC/2008 concerning Procedure to Release Imported Goods from Customs Area to be piled in Bonded Storage;

6. Regulation of the Director General of Customs and Excise Number P-22/BC/2009 concerning Import Customs Notification;

7. Regulation of the Director General of Customs and Excise Number P-42/BC/2009 concerning Try Out Implementation of Electronic Data Exchange (PDE) of Notification of Imported Goods to be piled in Bonded Storage (BC 2.3)

DECIDED:

To stipulate:

DECREE OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE CONCERNING FULLY IMPLEMENTATION (MANDATORY) OF ELECTRONIC DATA EXCHANGE FOR NOTIFICATION OF IMPORTED GOODS TO BE PILED IN BONDED STORAGE.

FIRST:

Establish the fully application (mandatory) of Electronic Data Exchange (PDE) on the application of Notification of Imported Goods to be Piled in Bonded Storage (BC 2.3) at the Customs Offices have carried out try outing as governed in the Regulations the Director General of Customs and Excise Number P-42/BC/2009 concerning Try Out Implementation of Electronic Data Exchange (PDE) of Notification of Imported Goods to be piled in Bonded Storage (BC 2.3).

SECOND:

The implementation of PDE BC 2.3 mandatory as intended in the FIRST dictum conducted periodically by the schedule as attached in the attachment that is an integral part of this Decree of the Director General.

THIRD:

The procedure for submission of BC 2.3 by using the PDE system to follow the provisions in the Regulation of the Director General of Customs and Excise Number P-20/BC/2008 Procedure to Release Imported Goods from Customs Area to be piled in Bonded Storage.

FOURTH:

Appoint Director of Customs Facilitation and Director of Customs and Excise Information as Project Implementation Unit for the implementation of PDE BC 2.3 as intended in the FIRST dictum and report the results of the implementation to the Director General at the first opportunity.

FIFTH:

This Decree of the Director General shall come into force from the date of stipulation.
